Drug offenses vary in severity. The lowest end of the spectrum is a first offense marijuana possession charge. The court is mandated to award the defendant an Adjournment in Contemplation of Dismissal (ACD), which means that the case will be dismissed and the record sealed if the defendant does not commit any new crime within a one year time frame.
The more serious types of drug offenses involve felony weight possession or trafficking in narcotics. The penalties here can be severe, depending on the defendant’s record and the nature of the offense. Many of these felony type arrests involve search warrants or undercover operations.
